Mother sues daughter claiming she ‘withdrew money’ and left the house

A mother filed a lawsuit before the Abu Dhabi Court for Family and Civil and Administrative Claims, in which she sued her daughter, and demanded that she be obliged to pay her Dhs85,000, while obligating her to pay expenses and fees, and legal interest at 12% from the date of filing the lawsuit, until payment is complete and obligating her to pay attorney’s fees.

The mother indicated in her lawsuit that her daughter used her bankcard, and withdrew Dhs85,000 from it, after which she left the house, and attached pictures of account statements.

The court indicated that, according to the law of evidence, the plaintiff must prove his right and the defendant has the right to deny it, and the burden of proving the alleged right is on the one who upholds it, and that the court is not obligated to conduct an investigation that was not requested by the litigants.

The court confirmed that the case papers did not contain any evidence of the validity of the mother's claim, nor did it request an investigation to prove her claim.

On the other hand, the daughter denied the validity of her mother's claim, and then ruled that the case be dismissed as it is and obligated the mother to pay the expenses and fees.
