Abu Dhabi Labour Court of First Instance ordered a company to pay Dhs251,461 to an employee who had worked for it for more than 13 consecutive years but was dismissed without receiving his dues, which included his delayed wages, end-of-service gratuity, annual leave allowance, and notice period allowance.
In detail, an employee filed a lawsuit against the company he worked for after resorting to the Ministry of Human Resources and Emiratisation committee, requesting the company be obligated to pay him his delayed salaries of Dhs309,296, a notice period allowance of Dhs15,700, an end-of-service gratuity of Dhs87,832, and an annual leave allowance of Dhs8,250, as well as obligating it to pay the lawsuit fees and expenses.
The employee stated in his lawsuit that he had worked for the company since 2012 with a basic salary of Dhs7,500 and a total of Dhs15,700, and that the company dismissed him without paying him his dues.
The court clarified that it was established through the wage protection statement and the lawsuit documents that the company did not pay the plaintiff Dhs140,453, his salary for several months, and that it terminated his services without notice, so he was entitled to Dhs15,700.
Regarding the end-of-service gratuity, the court affirmed that the employee's service period with the company exceeded 13 years and his basic salary was Dhs7,500, so he was entitled to Dhs87,808, in addition to the annual leave allowance, Dhs7,500, which is calculated based on the basic salary.
