Abu Dhabi Court for Family, Civil and Administrative Cases obligated a young man to pay Dhs100,000 to a husband and wife, as he broke the window of their room in a hotel using a sharp tool and entered it, forcing them to run away.

The details of the case date back to an earlier time, when a man and his wife filed a lawsuit against a young man and the management of a hotel, requesting that they be obligated to pay jointly a compensation of Dhs500,000 for the material, health, and psychological damages they incurred and the damage to their reputation, dignity, and social status, in addition to a legal interest of 9% from the date of the filing the case until full payment, and  the fees and expenses of the lawsuit and the lawyer’s fees.

The appellants said that while they were in a hotel room, the first appellee broke its window with a sharp tool and broke into it, so they ran away.

They added that he was referred by the Public Prosecution to court, where he was convicted based on a preliminary criminal ruling and fined Dhs5,000 and was obligated to pay the case fees, and Dhs3,500 for the services of the Forensic Sciences Centre.

The court explained that the hotel management did not do any mistake because it provided all means of protection, and that what the first appellee did was not due to negligence.

Therefore the court rejected the lawsuit against the hotel management.

Regarding the request for obligating the first appellee to pay compensation, the court indicated that according to the Civil Transactions Law, any harm to others obligates the perpetrator to give compensation and therefore it obligated him to pay Dhs100,000 to the appellants as a comprehensive compensation.
