Court orders firm to pay employee compensation

The Court of Cassation in Abu Dhabi upheld the Appellate Court ruling compensating an employee with Dhs241,454 for his late wages, an end-of-service bonus, compensation for an arbitrary dismissal, and his leave allowance.

Details date back to an earlier time when the employee filed a labour lawsuit in which he requested to obligate the company for which he worked to pay him his late wages for the last two years, besides 3 months payment in compensation for arbitrary dismissal, end of service bonus, annual leave allowance, warning allowance, and a return ticket for him and his family.

He also requested that the company be obligated to hand him an experience certificate, pay back delayed rents, the tuition fees for his children, furniture transportation fees and insurance fees.

The employee indicated that he joined the company upon an indefinite contract which lasted about 4 years for a total wage of Dhs13,185, but the company did not adhere to the terms of the contract and did not pay him his wages, so he quitted.

The court required the company to pay the employee D158,220 for his late wages, Dhs36,599 for the end-of-service allowance, Dhs7,080 for the leave allowance, and Dhs39,555 in compensation for unfair dismissal, bringing the total amount to Dhs241,454, in addition to a return ticket for him, or its value. The court also obligated the company to provide him with an experience certificate.
